The FAA has now released their new registration rules and you need to know how this will affect you. We are going to break it down so that you know what you need to do to be in compliance with the new rules.
When do I have to be registered by?
While registration is going to open on Monday, Dec 21st, the deadline to register is February 19th.
Should I register immediately?
This is certainly a matter of opinion but the AMA suggests holding off as until they make a different recommendation or until the deadline hits.
What is the biggest complaint about having to register?
The biggest problem is security of the data. It has been stated that the database is publicly searchable by registration number. A programmer could easily write code to extract all of the data and create websites showing all the local drone owners in an area. While an adult can give permission for this, the FAA is requiring children as young as 13 to register.
What kinds of model aircraft need to be registered?
The simple answer none. You do not register your aircraft at all, you register as a UAS operator.
Who needs to be registered?
All UAS operators that are operating a UAS for recreational purposes that weighs between .55 lbs and 55 lbs. You must be at least 13 years old to be registered.
Isn’t this a violation of Congress’ law against federal agencies creating laws against model aircraft?
That is exactly what some people are saying and why the AMA is telling people to hold off. I am not a lawyer, but it appears the FAA is trying to use a loophole by registering the operator and not the aircraft itself.
What if I don’t want to register?
Failure to register may result in regulatory and criminal sanctions. The FAA may assess civil penalties up to $27,500. Criminal penalties include fines of up to $250,000 and/or imprisonment for up to three years. Of course this means you need to be caught doing something and it is unclear who will enforce the registration.
What does it cost to register?
The costs is $5 to register and needs to be renewed every three years at a cost of $5 each time.
What information do I need to provide in order to register?
You will be providing your name, address, and email address, along with a credit card for the fee.
Do I have to provide information on all of my equipment?
Individual recreational users do not have to enter the make, model, and serial number of their equipment.
What do I need to do to make sure my drone is registered properly?
Once you get your registration information from the website, you need to put your personal registration number on each of your aircraft. It can be anywhere on the aircraft so long as no tools are required to get to it.
What will the registration information be used for?
According the the FAA, the information will be used to track a UAS to an owner should there be an incident of some kind and to help recover lost or stolen equipment.
